Cool Socials™ Terms of Service
These Terms of Service (“TERMS”) are effective as of July 1, 2016 and govern your use of our Service. These terms will also govern any free trial that you registered for our Service.Acceptance of Terms
This agreement represents a legally binding contract. It may be revised from time to time, and you agree you will review it and any updates as requested.Availability of the Site
You must be at least 13 years of age to use the Cool Socials Service. You represent that you are legally authorized and able to enter into a binding agreement with Cool Socials. If you are using the Cool Socials on behalf of a business, you must be authorized by that business to use the Service, as the business is now bound to these Terms.Description of Service
The CoolSocials “Service” means the website located at www.coolsocials.com.jm, coolsocials.com and any other websites and associated Internet services under CoolSocials’ control, whether partial or otherwise. The Service provides an online platform that enables you to manage your social media marketing profiles. You may use the Service to connect with other websites, and you agree to comply with their terms and conditions. You must comply with the CAN-SPAM Act of 2003 and are not allowed to send spam. We may terminate your use of the Service if the number of complaints your emails generate is higher than the industry norm. CoolSocials shall use best efforts to keep the Service up and running, however, some factors are out of our control (e.g. acts of God, acts of government, fires, floods, civil unrest, Internet service provider failures, etc.). We may need to address such problems which could affect the availability of the Service.Third Party Services
The Service allows you to post and retrieve content from third-party websites such as Facebook, Twitter and LinkedIn. CoolSocials may suspend your access to Service if you don’t comply with the Terms. You agree that we may inform third parties of the fact that you are our client.Billing, Plan Modifications and Payments
CoolSocials will charge a fee to use the Service and may change the fee strucutre at any time. We will automatically charge your credit card or PayPal account when payment is due. We will not refund any payments. All payment transactions are done in U.S. dollars. You are responsible for all payment fees charged by payment processors through the Service.Intellectual Property Rights
CoolSocials owns all of the content we create, however while you use the Service, you may use it also. You cannot use our logo without our written permission.It is crucial that you have permission to use third party content or they may be able to sue you for violation of their legal rights. You or the people who allow you to post, own all of thecontent you post using the Service, including the information about your customers and marketing content. However, CoolSocials may utilize the content and may use aggregated information to market our Services. Please inform us if you believe a user has violated your copyright while using the Service, or if you believe someone incorrectly reported you as violating his or her copyright.Use of the Service
You shall be responsible for your compliance with our Terms and use best efforts to prevent unauthorized access to or use of the Service, and notify CoolSocials immediately of any unauthorized access which you become aware; and you accept to only use the Service in accordance with these Terms, the Documentation, and all applicable government laws and regulations. You shall not sell, resell, rent, lease the Service or make the Service available to any third party. CoolSocials may communicate with you by email or by posting notice on the Service.Data Privacy and Security
We will keep any information you post on the Service confidential. We also pledge to keep any business and marketing plans, technical information, product plans, and business processes confidential as well. All parties pledge to use reasonable care to protect the Confidential Information as we would our own confidential information.Disclaimer of Warranties and Liability
You are responsible for your posts and actions when using the Service or any content made available on the Service. Do not attempt to interfere, harm or steal anything from the Service. If you do not act in an acceptable manner, we may cancel or resrtict your use of the Service. You use the Service at your own risk. CoolSocials makes no guarantees or warranties.Limitation of Liability
CoolSocials is not liable for the actions of our users when they use the Service. We may alter the Service at any time and are not liable for how this may impact you. We do not guarantee the accuracy or quality of any content youencounter using the Service or other websites.Governing Law
These Terms shall be governed by the laws of Jamaica without regard to its conflict of other law provisions.Arbitration of Disputes
We will use arbitration to resolve any problems. CoolSocials is located in Jamaica, so all disputes must be resolved there. You cannot join a class action lawsuit or obtain a jury trial for any disputes you have with us related to your use of the Service.Contact Information
